New Outdoor Growing Laws
As of April first of this year, HB 4851 takes effect. This bill better defines rules for Medical Marijuana patients and caregivers to grow outdoors. If a grower wants to stay in compliance, follow these guidelines when constructing your growing structure: [MARIHUANA PLANTS GROWN OUTDOORS ARE CONSIDERED TO BE IN AN ENCLOSED, LOCKED FACILITY IF THEY ARE GROWN WITHIN A STATIONARY STRUCTURE THAT IS ALL OF THE FOLLOWING:
(1) ANCHORED, ATTACHED, OR AFFIXED TO THE GROUND.
This is a simple fix. Four by four posts can easily anchored into the ground with a post digger and some fast drying concrete mix.
(2) LOCATED ON LAND THAT IS OWNED, LEASED, OR RENTED BY EITHER: (A) THE REGISTERED QUALIFYING PATIENT TO WHOM THE MARIHUANA PLANTS BELONG. (B) THE PERSON DESIGNATED THROUGH THE DEPARTMENTAL REGISTRATION PROCESS AS THE PRIMARY CAREGIVER FOR THE REGISTERED PATIENT OR PATIENTS.
This means that the patient, and/or caregiver, cannot grow anywhere that is not theirs. Property where the grow is located must be leased, rented or owned by the person allowed to possess the plants.
(3) EQUIPPED WITH FUNCTIONING LOCKS OR OTHER SECURITY DEVICES THAT PERMIT ACCESS ONLY BY THE REGISTERED PRIMARY CAREGIVER OR REGISTERED QUALIFYING PATIENT WHOSE PROPERTY THE STRUCTURE IS LOCATED UPON.
Grow structures must be locked. Don’t ever leave your enclosure open for unneeded lengths of time.
(4) ENCLOSED ON ALL SIDES, EXCEPT FOR THE BASE, BY CHAIN-LINK FENCING, WIRE MESH, WOODEN SLATACCESS BY THE GENERAL PUBLIC.]
When constructing your grow structure you will need to build walls and some sort of roof. Walls can be made with chain-link or wooden fence, and must fully enclose in such a way that the grow is not visible from adjacent properties. Natural surroundings such as trees and other structures can suffice. Translucent green houses covers can be used on the roof of your structure. If your green houses is not secured (plastic and aluminum) it is advised to surround it with some sort of locked parameter fence. |
